Terms of Service

These Terms of Service govern your access to and use of Project Roger by Hesson Innovations LLC. Please read them carefully before using the platform.
1. Acceptance of Terms
By accessing or using Project Roger (the "Platform"), operated by Hesson Innovations LLC ("Hesson Innovations", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Description of Service
Project Roger is a cloud-based inspection management platform designed for commercial trucking, crane and heavy machinery operations, and dielectric testing companies. The Platform allows organizations to create and manage inspection templates, conduct inspections, generate PDF reports, manage team members, and share reports with clients via a branded portal.
3. Access and Accounts
Access to Project Roger is granted by invitation only. You must be approved by Hesson Innovations or an authorized administrator to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at hello@hessoninnovations.com if you suspect unauthorized access.
4. Billing and Payment
Project Roger operates on an invoice-based billing model. Pricing is agreed upon before access is granted. Invoices are issued on a schedule communicated at onboarding. Failure to pay may result in suspension of access. We reserve the right to update pricing with reasonable advance notice.
5. Permitted Use
You may use the Platform solely for your organization's internal inspection management and reporting purposes. You may not resell, sublicense, or transfer access to the Platform. You may not use the Platform in any way that violates applicable laws or regulations, including data privacy laws applicable in your jurisdiction.
6. Data Ownership
You own the data you enter into Project Roger. Hesson Innovations does not claim ownership of your inspection records, templates, organization information, or client data. We process your data only as necessary to provide the service. You may export or request deletion of your data at any time by contacting us.
7. Privacy
Our handling of personal data is described in our Privacy Policy, which is incorporated by reference into these Terms. By using the Platform, you consent to the data practices described in the Privacy Policy.
8. Intellectual Property
The Project Roger platform, including its design, code, and underlying technology, is the property of Hesson Innovations LLC. Nothing in these Terms transfers any intellectual property rights to you. You retain full ownership of your data and content.
9. Disclaimers
The Platform is provided "as is" without warranties of any kind. Hesson Innovations does not warrant that the Platform will be uninterrupted, error-free, or free of security vulnerabilities. Inspection reports generated by the Platform are tools to assist compliance — they do not constitute legal certification and should not replace professional engineering or safety assessments.
10. Limitation of Liability
To the maximum extent permitted by law, Hesson Innovations shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform. Our total liability to you for any claim shall not exceed the amounts paid by you to us in the six months preceding the claim.
11. Termination
We may suspend or terminate your access to the Platform at any time for violation of these Terms, non-payment, or at our discretion with reasonable notice. You may cancel your subscription by contacting us at hello@hessoninnovations.com. Upon termination, you may request an export of your data within 30 days.
12. Governing Law
These Terms shall be governed by the laws of the State of West Virginia, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Wood County, West Virginia.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Platform. Continued use after changes are posted constitutes acceptance of the updated Terms.
